Thomas M. Spear and Joshua A. Fein have been providing receivership services for the Superior Courts throughout Southern California since 1991. Both Spear and Fein are on the Approved List of Receivers for the County of Los Angeles. Spear and Fein are the sole principals of Property Management Associates, one of the largest privately-held property management companies in Southern California. Within the last year, they have provided receivership services in the counties of Los Angeles, Orange, San Bernardino, Riverside, San Diego, Santa Barbara and Ventura.
As Receivers, Spear and Fein have successfully completed in excess of six hundred Receiverships throughout Southern California.
Receivership Services:
n Provide Declaration to Court in order to approve appointment of Receiver.
n Review Order Appointing Receiver to define Receivership requirements, which may be specific to the Order and not statutory.
n Prepare Oath and Receiver's Surety Bond and file same with the proper Court.
n Prepare Demand and contact defendant and all other parties in order to obtain all necessary monies and documents to successfully control the subject asset.
n Work with attorneys and make necessary Court appearances for Ex-Parte Motions and/or Contempt Motions necessary to exercise the requirements of the Receivership Estate.
n Prepare Service List and provide copies of documentation requiring service and proof thereof.
n Provide monthly interim accounting and reports to all parties.
n Upon termination of Receivership, prepare and file necessary Report and Final Accounting of Receiver with the Superior Court.
As Receivers, in order to provide cost effective service, Spear and Fein provide necessary requirements of the Receivership Estate without having to go to outside counsel and consultants. Most motions and orders necessary for the Receivership Estate can be prepared by plaintiff's counsel. Combining receivership and property management services provide a more cost effective result to all parties.
As Receiver, a relationship is created with both plaintiff and defendant so that any issues which may require court approval or may be disputed issues can be resolved through the Receiver and not through costly, protracted adversarial Court and legal proceedings.
Finally, as Receivers, both Spear and Fein have the technical knowledge and a long history of business and real estate experience which allows them to oversee the management of assets by any entity to maximize the value and operating levels of that asset.
